No medical, clinical or diagnostic use
This page exists separately from the research use statement because it gets cited on its own — in purchase orders, in supplier agreements, and in the paperwork institutions attach to incoming material. It is written as numbered clauses so a clause can be referenced by number.
No material or service supplied through Wetware World may be used in or on a human being, in clinical diagnosis, in treatment, or in any therapeutic or veterinary application.
Nothing supplied is a medical device, an in vitro diagnostic, a drug, a biologic, or a product intended for implantation, transplantation, infusion or transfer into a human or animal recipient.
This prohibition is a condition of supply. It applies to every quotation line, to every catalogue entry, and to every service, whether or not the individual listing repeats it. It applies to derivatives of the material and it survives delivery. It is not waivable by conduct, by a contrary term on a purchase order, or by anything said in correspondence outside a signed variation.
The broader use restriction, the approvals framework and the handling obligations are set out at research use only. This page states the medical-use prohibition alone, in a form that can be quoted.
1Prohibited uses
The following uses are prohibited without exception:
- 1.1 Administration to, implantation into, transplantation into, infusion into, or transfer into a human being, by any route, in any quantity, for any purpose.
- 1.2 Use in the diagnosis of disease or of any other condition in a human being, including use as, or as a component of, an in vitro diagnostic assay applied to a patient sample for a clinical purpose.
- 1.3 Use in the treatment, prevention, mitigation, cure or monitoring of disease in a human being.
- 1.4 Use in a clinical trial, an expanded access programme, a compassionate use programme, or any investigational use in human subjects.
- 1.5 Use in the manufacture of, or as a starting material, intermediate, excipient or component of, any medicinal product, biologic, advanced therapy medicinal product, cell or gene therapy, medical device, or in vitro diagnostic device.
- 1.6 Use in assisted reproduction, in the creation of a human embryo, or in any application involving the human germ line.
- 1.7 Use in the treatment of animals, in veterinary practice, or as a veterinary medicinal product.
- 1.8 Use in food, feed, cosmetics, supplements, or any product intended for human or animal consumption or topical application.
- 1.9 Any use in a person's body or on a person's body, including self-experimentation.
2Regulatory status
2.1 Nothing supplied through Wetware World has been evaluated, cleared, approved, authorised, registered, licensed or certified for any medical purpose by any regulatory authority in any jurisdiction.
2.2 Wetware World holds no marketing authorisation, no medical device clearance or approval, no CE marking for a medical purpose, no UKCA marking for a medical purpose, and no in vitro diagnostic registration.
2.3 Nothing supplied is manufactured under good manufacturing practice, good laboratory practice, good tissue practice, or any clinical-grade quality system, unless a specific quotation line names an accreditation and names the accredited supplier holding it. Any such accreditation is a statement about that supplier, not about Wetware World, and it does not alter the prohibition in clause 1.
2.4 The absence of a regulatory determination is not a determination of safety. Material supplied for research has not been assessed for safety in a human being and must not be treated as if it had.
3Scope
3.1 This prohibition applies to all cells, tissues, engineered constructs, devices, substrates, media, reagents, consumables and documentation supplied, and to all contract culture, differentiation, banking, fabrication and characterisation services performed.
3.2 It applies to derivatives. Material expanded, differentiated, modified, banked, incorporated into a construct, or otherwise derived from material supplied through Wetware World remains subject to this prohibition.
3.3 It applies to data. Data generated from the material may not be used to support a clinical diagnosis, a treatment decision for an identified patient, or a regulatory submission that represents the material as being of clinical grade.
3.4 It travels. If you transfer material or a derivative to a third party, you must pass this prohibition to them in writing and secure their agreement to it before transfer. Onward transfer may additionally be restricted by a material transfer agreement or licence attached to the material.
4Buyer acknowledgement
By placing an order, the buyer acknowledges and agrees that:
4.1 the buyer has read this prohibition and it forms part of the contract of supply;
4.2 the buyer is acquiring the material or service for laboratory research use only, performed by qualified personnel;
4.3 the buyer will not put the material to any use listed in clause 1, and will not permit any person under its control to do so;
4.4 the buyer is solely responsible for determining that its intended use is lawful in its jurisdiction and permitted by its institution;
4.5 no statement made by Wetware World, in any medium, may be construed as a representation that the material is suitable for a medical purpose, and no such representation is given.
5No implied fitness for a medical purpose
5.1 Wetware World gives no warranty, express or implied, that any material or service is fit for a medical, clinical, diagnostic, therapeutic or veterinary purpose. Any such implied warranty is excluded to the fullest extent permitted by law.
5.2 A specification, a certificate of analysis, a screening result, or a quality document supplied with the material describes what was measured in a research context. It is not evidence of clinical suitability and must not be presented as such.
5.3 Descriptions of a material as human, human-derived, physiologically relevant, clinically relevant, disease-modelling or patient-derived are scientific descriptions. They do not indicate clinical grade, regulatory status, or suitability for use in a person.
6Liability for prohibited use
6.1 Wetware World accepts no liability of any kind arising from a use prohibited by clause 1, whether that use is by the buyer, by the buyer's personnel, or by a third party to whom the buyer transferred material.
6.2 The buyer indemnifies Wetware World and its suppliers against claims, losses, penalties and costs arising from a use prohibited by clause 1 that is attributable to the buyer or to a party to whom the buyer transferred material.
6.3 Nothing in this clause limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.
7Enforcement
7.1 Every order requires an affirmative research use attestation. It is a hard gate: an order cannot be placed without it.
7.2 Where Wetware World forms a reasonable belief that material has been or is intended to be used contrary to clause 1, it may decline to supply, suspend or cancel outstanding orders, decline future business, and where required by law report the matter to the relevant authority.
7.3 Wetware World will not pursue a customer for asking whether a clinical route is possible. Asking is not a breach. Proceeding without saying so is.
If your programme has a clinical destination, say so early. The realistic answer in phase one is that a different supplier, a different material grade and a different documentation set are required from the outset, and that we cannot get you there today. Knowing that at quotation stage is worth more than a shipment you cannot use.
